16th Nov, 2002 marriage solemnised at Abhinandan Guest House,Aliganj, Lucknow- Avinash with
Rittu (Ruchita).
· After 2 months Avinash, being working at Delhi, took Ruchita alongwith himself with parents
consent. And they started living together independly.
· Ruchita concieved in feb 2003 but the foetus was deformed, hence doctors recommended abortion.
(Medical reports and ultrasound reports available of various doctors consulted.)
· 14th feb, 2003, the deformed foetus was cleaned by Dr. Sudha Nigam after bringing Ruchita back
to lucknow since Avinash was not capable of handling the situation alone at Delhi.
· Ruchita’s parents came to lucknow and requested us to take her to Agra so that her environment
changes and she recovers fast. Avinash had been continuosly visiting her during this period (about
a fortnight) giving her pocketmoney to bear her dail expenses. Ruchita returned to Delhi when she
recovered fully. Even then Avinash took her to an experience and reputed physician at Delhi
(medical prescription available).
· Since then Ruchita and Avinash had been living together in rented premises at Badarpur, Kalkaji
and Pitampura.
· 1st April 2004, Ruchita joined Rishikul Vidyapeeth, Alipur as a Dance teacher as a salary of Rs.
8,990/- with her separate salary account.(Verification may be done from school).
· April 2004, Ruchita concieved again. She continued with the school on the ground that she would
take medical leave.
· October 2004, Ruchita resigned from her services at Alipur, Delhi.
· Since my father is a neuro patient, physically and mentally handicapped, it was decided mutually
that the delivery of Ruchita shall take place at Agra so that there are no hygienic issues caused
by the ill father at lucknow and Avinash being not competent alone to take care of delivery.
(Father’s prescription of illness since last 14 years available) .
· Therefore on 12th or 14th November, 2004, Avinash took Ruchita to her place in Agra and he used
to continuosly keep in touch though phone and personal visits.
· 6th of December Ruchita gave birth to a baby boy, now named Master Kartik, at Agra in a private
nursing home. During this period, Avinash had been continuosly giving the expenses to her mother
and ruchita. Even on the date when Avinash visited nursing home rs. 5000 was given to her mother
(this withdrawal may be checked from my savings account since this amount was withdrawn from an ATM
at Agra only.)
· In the meantime, Avinash left his job at Delhi and started his own computer consultancy at a
cyber café sold to him by a business man who was not able to run it. Avinash became the owner of the
business and started the cyber café at Vikas Nagar, Lucknow.
· Ruchita returned to Lucknow and being the parental home being not sufficient to accommodate much
people and on Ruchita’s request to live independently, shifted at Jankipuram in an independent
house on rental basis.
· 3rd of October, news came from Agra that Ruchita’s mother had met with an accident and she has a
fracture in her hand. Ruchita insisted that she wants to see her mother. Despite severals requests
by Avinash and his parents, to go after celebrating the marriage anniversary on 16th november and
Kartiks’s birthday on 6th december, she said that she wants to go home only for a week to which
Avinash and his family agreed she was arranged with a reservation for Agra on 14th of October and a
a return ticket of 29th of April, 2005 (which may be verified from the railways), since she was
expected to be back by Diwali.
· 21st of October, Avinash went to Agra to see her mother.
· 29th of October, 2005, Avinash called up Ruchita and she said she was not coming and handed over
the phone to her father, after which hot discussions took place. Her father hung up the phone and
respite many efforts by Avinash to speak to Ruchita, either her mobile was switched off, or the
phone was not being picked up.
· 3rd of November after several attempts by Avinash, the phone was finally picked up but from the
other side came a stream of abuses and threats.
· 6th of November, some policeman, in a jeep with a political party flag on it, came to Avinash’s
residence and asked him to get into the jeep on gunpoint. They simply told that a case had been
registered against him by his wife.
· Avinash’s brother was picked up from the parental house in Aliganj and was stripped off with his
mobile and wallet and nobody was allowed to contact anybody, not even the advocate, same as for
Avinash, at gunpoint.
· Avinash’s mother and father were picked up from RadhaSoani Satsang house at Rae Bareilly Road
when they were returning from the Satsang. They stopped the bus from which they were coming,
announced that they have Avinash (me) in their custody and they have to surrender, else my encounter
shall be done. My parents surrendered and came into their Jeep.
· Upto now, they had Ruchita’s Bua’s son and his friend, a local Agra political goon, who had been
guiding them of everything. They stopped the jeep at railway station and they asked my handicapped
father to leave on his own by a taxi for home. Ruchita’s brother also got down to leave by train
(or bus). But he left the Jeep. When a voice was raised by Avinash’s mother asking for the arrest
warrant, they whipped out their pistols and threatened her of encounter to which Avinash got
terrified and asked his mother to get back into the Jeep.
· They reached Agra mahila thana, rakabganj, the same night at about 10 PM. They were given with
blankets to sleep on the floor in the office.
· Next day Ruchita’s family came and demanded 7 lacks and mutual divorce failing which we all
shall go to Jail. In the meantime, Avinash’s relatives also reached there and negotiated the amount to
Rs. 4 lacks , to be paid in two instalments, since we cannot efford such big amount and we need
some time to arrange it, and it was agreed. On mutual agreement, Alok, Avinash’s brother was left to
arrange for money with his relatives.
· It took 2 1/2 days for Alok to manage money and get back to Agra. For 5 days we lived in the
police custody and no GD entry was done for us. Till the time Alok came back with the money, Avinash
and his mother were constantly threatened to be sent to jail if he takes longer time.
· On 12th, the draft of Rs. 2 lacks was finally handed over to Ruchita’s parents and a mutual
compromise signed and Avinash, Alok and his Mother were set free.
· Immediately after that, Avinash was asked to go to the family court and signed on the divorce
papers, failing which again they shall have to go to Jail. Though Avinash loved Ruchita and didn’t
wanted to part, still he had to sign on the divorce papers and left for Lucknow.
· In the whole span of 3 years, Ruchita and Avinash had been living separately and independently
at Delhi and there was no dispute between them. Avinash’s Parents, his aged mother and a
handicapped father had come only twice to Delhi.Once at Kalkaji when his father succumbed to some severe
injuries and had to be admitted in AIIMS (medcal prescriptions available) and second at Pitampura
(again to show father to Rajya Vaidya for treatment (medical prescriptions available).
· During this 3 years span Ruchita had visited Lucknow only 3 times, since she was also working.
· That’s what actually happened.
Now what had been lodged in the FIR
· 16th of November, 2002 marriage of Avinash and Ruchita Solemnised.
· Immediately after 2-3 months, Avinash and his family started demanding dowry and she was
physically assaulted. (She was at Delhi at that time, and even if was at Lucknow, was she not literate to
lodge the FIR at very that time? Does she carry any medical report that she had been physically
abused?)
· She complained of indecent behaviour by brother in law, Alok (how could Alok do that when she
was in Delhi and still, why didn’t she lodge an FIR against Alok that very time when the incident
took place?)
· Then she says she left for Delhi after 8-10 days after complaining to Avinash of the problems at
Lucknow (why didn’t she even give a written complaint at the police station then only?)
· After that she writes, Avinash’s Mother and father had come to Delhi, assaulted her physically
and she being pregnant, got her back to Lucknow, and aborted the kid. (That was done forcibly, she
means that. Reports clearly say that the foeteus was deformed and would lead to a handicapped
baby, mayb not alive.)
· She write to her father on 17th april and 10th october telling him of her pains. Her father came
to Lucknow, as per her on 24th april to understand the issues. (fine, but she was sent voluntarily
by Avinash on 14th with a return reservation with a return reservation. Why the return reservation
when she was not supposed to come back?)
· 6th of december, Kartik, the son was born at a private nursing home at Agra and she stayed there
for 4 months until she recovered fully.
· 23rd of March, 2005 she claims she was again teased by Alok, her brother in law (how was that
possible when she was in Agra that time and came just back before Holi?)
· 11th October, 2005 she claims Alok tried to rape her (he had been till that married that time
and would rather sleep with his wife).
· In the meantime, she claims, her father came and gave her Rs. 25000 to arrange for Kartik’s
birthday. Where was the money spent? She was living independly.
Now, she living individually with her husband, how can claim she had been assaulted for dowry.
What evidence does she hold for it?
Since half the payment is already been given,and the second half yet to be paid at the time the
divorced is declared. Our petition for divorce had been filed on 12th of Nov, 2005 and our date for
divorce is 12th of May, 2006. Then the second half of the payment shall be made. If something can
be done that can save our lives without us being sent to jail, please help me. Else I wont be
ready because if we go to jail, my brother and my brother in law(jijaji) shall also go to jail and
they shall lose their govt. jobs. I don’t want to be responsible for it. But if something can be done
without been sent to jail, I shall be happy to join the fight against this terrorism.
